I can only speak to my experience, but for whatever that is worth, the prosecutors (at both the state and federal level) that I have met have always struck me as the smartest, most hard-working and dedicated lawyers.

^def. not my experience but I mostly worked around issues of police brutality and or other civil disobediences regarding colonialism

definately this is a borderline situation, but in Louisiana, it's legal to use deadly force for someone breaking into your car, even if you are not in it.  This was the result of a huge epidemic of car jackings in the 1990s.    The sensitive liberal in me says, "holy crap, just call the cops and stay inside".....the redneck deep inside would have liked to see the look in their eyes when he racked a shell in the 12 guage.....

I'll bet if he had a handgun, they'd have lived (longer)

Not that I am aware of, but if my neighbor walked in, fearing someone has broken in and she walks down the stairs with something in her hands, and he shot her because he thought it was a gun...

Law, is it legal to shot people in the back? No!

Don't get me wrong I understand the barbaric poetic justice part of it but killing people is just way to heavy for me. Then again I'm a pinko flaming lib thats looks up to the heaven thankfully every time I cut the Romain lettuces from the veggie box. 

This is scary to say but I do agree with you on some levels.   Wink  I have a real problem with the fact that these guys were shot in the back.  I don't have a problem with the fact that two burglars were shot.

but based on the evidence (W, Dick, Ross perot, Yosemite Sam) all old guys in Texas are drunk and ornery critters. 

in reality I know about as much about living in the community where this Texas old guy shot the burglars as I do about Yosemite Sam's drinking habits, I am thankful that the founding fathers intended local communities to judge themselves instead of having all us big city metrohead types tell them what they have to do. This guy had just as much of a legal right to walk as OJ did.  I always thought there were 4 basic risks to breaking and entering someone's home, (1) going to jail for serious time (not the same as getting arrested), (2) finding the homeowners home and  having to beat them down before they did the same to me or called the cops resulting in "1" above, (3) getting shot or having skull caved in with a 5 iron, and (4) hurting yourself carrying heavy objects out of the home illegally.  those are the occupational hazards of that form of income like it or not - I have no sympathy for these guys at all.

Since it wasn't his house that was being broken into , it would seem that a store owner would be more justified shooting  shoplifters in the back as they left his store .... with the economy as bad as it is , and some people doing what ever it takes to survive, judgments like this and recent supreme court decisions on gun ownership surely will result in more gun violence.
As for this guy being a hero for shooting two unarmed people in the back ... seriously ?

Texas should be its own country since they just could give a rats azz about the constitution or Human Life for that matter. Oh wait, unless its a baby, then they fight to the death to protect an unborn baby, but then once its born if it grows up poor then hey, fark that thing, Kill it either by playing God & service a death sentence for doing what it takes to survive poverty or let it rot in the streets so it stops collecting welfare. GOP style! YEEEHAAAW!!!! It seems the only part of the Bible (wich they claim to live so perfectly by) they choose to really Ignore is the whole "Thou shall not Kill" part.

good point, but people are responding to the initial intent not the finish. These situations come down to intent.  A gun held without an intent to use it may not be much of a deterrent to some if they sense the gun holder will not pull the trigger - the old guy most likely knew he couldn't restrain these guys physically so he walked out with the intention of shooting them - even told the 911 operator he intended to do it instead of waiting for the police (anyone know the average police response time in that community?). He decided he would rather go to jail or get shot himself (assuming he could not tell if they were armed or not) than have people think they can break and enter into his neighborhood homes - that is not your typical I don't want to get involved or get in trouble response.  I'm not sure if this serves as a deterrent there in Texas but I know first hand that it worked for the neighborhood around Gotti's place in Ozone Park back in time. I mean who really wants criminals forcing themselves into their or their little son or daughter's window at night or their neighbor's family home? - the stuff taken doesn't matter - it's the potential of what can develop if they enter when you are home that matters and that scares the hell out of young and old alike.   Him getting off does give him a pass (he had no way of knowing if the jury would indeed let him off when he made his decision) but it is a perfectly legal pass.
